mailto:jpcwaqf-lss@sansad.nic.in?subject=Public%20Suggestions%20on%20The%20Waqf%20(Amendment)%20Bill%202024&body=To%2C%0A%0A1.%20Shri.%20Jagdambika%20Pal%20MP%2C%20Chairperson%2C%20Joint%20Committee%20of%20Parliament%2C%20WAKF%20Amendment%202024%0A%0ASubject%20%3A%20Public%20Suggestions%20on%20The%20Wakf%20(Amendment)%20Bill%202024%0A%0ARecently%2C%20the%20nation%20was%20jolted%20by%20the%20startling%20revelation%20that%20a%20completely%20Hindu%20village%20in%20Tiruchendurai%2C%20Tamil%20Nadu%2C%20which%20houses%20a%20Hindu%20temple%20over%201500%20years%20old%2C%20has%20been%20designated%20as%20Waqf%20property.%20This%20has%20left%20Hindus%20baffled%2C%20as%20they%20wonder%20how%20a%20religion%20that%20arrived%20in%20this%20region%20in%20the%2010th%20century%20can%20claim%20ownership%20of%20land%20and%20a%20temple%20that%20existed%20long%20before%20its%20arrival.%20The%20Waqf%20Act%20is%20the%20root%20cause%20of%20this%20injustice.%0A%0AI%20would%20want%20want%20to%20highlight%20the%20oppressive%20aspects%20of%20the%20Waqf%20Act%3A%0A%0A1.%20Waqf%20refers%20to%20a%20property%20donation%20made%20by%20a%20believer%20to%20be%20managed%20by%20a%20trust%20for%20religious%20or%20charitable%20purposes.%20According%20to%20the%20true%20definition%20of%20Waqf%2C%20the%20property%20is%20dedicated%20to%20serving%20Allah%2C%20and%20thus%2C%20its%20use%20is%20governed%20by%20Islamic%20law.%0A%0A2.%20Additionally%2C%20the%20Waqf%20Act%20requires%20the%20Government%20to%20conduct%20a%20survey%20of%20all%20Waqf%20properties%20every%2010%20years.%20But%20who%20funds%20this%20survey%3F%20The%20taxpayer!%20Why%20should%20the%20taxpayers%2C%20who%20primarily%20belong%20to%20the%20majority%20community%2C%20bear%20this%20cost%3F%0A%0A3.%20The%20Waqf%20Act%20includes%20a%20harsh%20provision%20that%20allows%20the%20Waqf%20board%20to%20seize%20any%20property%20without%20notifying%20the%20person%20who%20owns%20or%20resides%20on%20the%20land%2C%20as%20was%20the%20case%20in%20Tiruchendurai.%20The%20only%20recourse%20for%20the%20affected%20person%20is%20to%20appeal%20to%20the%20Waqf%20tribunal.%0A%0A4.%20The%20Waqf%20tribunal%2C%20under%20section%2083%20of%20the%20act%2C%20is%20governed%20by%20Sharia%20law.%20How%20can%20it%20be%20just%20that%20a%20non-Muslim%20is%20compelled%20to%20seek%20justice%20from%20a%20tribunal%20operating%20under%20Islamic%20law%3F%0A%0A5.%20Section%2085%20is%20even%20more%20troubling.%20Civil%20courts%20have%20no%20authority%20over%20such%20disputes!%20It%20is%20crucial%20to%20note%20that%20no%20other%20minority%20group%20(Sikhs%2C%20Jains%2C%20Parsis%2C%20etc.)%20has%20been%20granted%20such%20sweeping%20powers.%0A%0A6.%20The%20Waqf%20Act%20is%20exempt%20from%20the%20statute%20of%20limitations%2C%20which%20contradicts%20the%20Limitation%20Act%20of%201963.%20This%20means%20that%20a%20Waqf%20Board%20can%2C%20at%20any%20time%2C%20lay%20claim%20to%20any%20property.%0A%0A7.%20Lastly%2C%20the%20Act%20grants%20the%20Waqf%20board%20unchecked%20power%20to%20claim%20any%20property.%20As%20a%20result%2C%20Waqf%20properties%20are%20estimated%20to%20encompass%20approximately%206%20lakh%20acres%20across%20the%20nation%2C%20making%20the%20Waqf%20board%20the%20third-largest%20landowner%20in%20India!%20This%20represents%20a%20covert%20appropriation%20of%20the%20country's%20resources%2C%20all%20under%20the%20protection%20of%20our%20own%20laws.%0A%0AThe%20Hon'ble%20Prime%20Minister%2C%20Shri%20Narendra%20Modi%2C%20recently%20remarked%20that%20we%20must%20rid%20ourselves%20of%20the%20colonial%20mindset.%20This%20mindset%20is%20not%20solely%20a%20British%20legacy%3B%20as%20long%20as%20this%20Mughal-era%20law%20remains%2C%20we%20cannot%20fully%20shed%20this%20colonial%20mentality.%20This%20is%20evident%20from%20the%20following%20two%20examples%3A%0A%0A1.%20Former%20Prime%20Minister%20Manmohan%20Singh%20once%20stated%20that%20minorities%20(specifically%20Muslims)%20have%20the%20first%20claim%20on%20India's%20resources.%0A%0A2.%20The%20Indian%20National%20Congress%20took%20this%20statement%20to%20heart%20and%20transferred%20123%20prime%20properties%20in%20Delhi%20to%20the%20Waqf%20board.%0A%0AThis%20is%20a%20direct%20affront%20to%20the%20secular%20values%20of%20our%20nation!%0A%0AIndians%20believe%20in%20equality%20before%20the%20law%20for%20all%20citizens.%20However%2C%20what%20remains%20hidden%20is%20that%20some%20are%20more%20equal%20than%20others%2C%20as%20is%20clearly%20demonstrated%20by%20the%20provisions%20and%20application%20of%20the%20Waqf%20Act.%0A%0AHence%2C%20following%20the%20constitutional%20principles%20of%20equality%20and%20justice%2C%20I%20demand%20that%3A%0A%0A1.%20The%20Waqf%20Act%20be%20immediately%20amended%20or%20repealed.%0A%0A2.%20All%20properties%20currently%20held%20by%20Waqf%20Boards%20across%20the%20country%20be%20taken%20over%20by%20the%20Government.%20Following%20this%2C%0A%0A3.%20High-level%20committees%20should%20be%20established%20at%20both%20the%20national%20and%20state%20levels%20to%20investigate%2
